Pedestrian Fatalities a Problem in Nevada
Nevada is a well-known problem state for pedestrian accidents, and awareness campaigns have been made numerous times over the years, highlighting the problem. In 2016, the state of Nevada declared an epidemic of pedestrian deaths, pointing to a spike in pedestrian deaths following two years in a row of record pedestrian fatalities.
The Nevada Department of Transportation implemented some road engineering improvements to help save lives and encouraged drivers and pedestrians to look out for each other. However, accidents still continue to occur, and pedestrians are still vulnerable.
Crosswalk Right-of-Way in Nevada
We have seen many cases in Nevada where striking by “failing to yield to a pedestrian at a crosswalk” constitutes reckless driving. At night, pedestrians are especially vulnerable to being struck by a car. Police will investigate and determine if the driver failed to yield. If the driver of the vehicle was determined to be at fault for this accident, he may face criminal charges.
Additionally, the victim’s family may pursue a wrongful death claim against the driver. If the report that the driver was in a marked crosswalk, investigators will consider that the victim may have had the legal right-of-way. Damages available in a wrongful death claim may include final medical / accident-related expenses, funeral and burial expenses, lost earnings and contributions the victim would have made over their lifetime, and loss of love and companionship.
