Pedestrian Struck By Car August 28th in Central Las Vegas

A pedestrian suffered serious injuries on Friday, August 28th, after being struck by a car in central Las Vegas, the Las Vegas Review-Journal reported. The accident was reported at West Lake Mead Boulevard and J. Street at 5:38 AM. The victim, only identified as a male, was taken to a hospital and reported to be in stable condition.

Who is Responsible for a Pedestrian Accident?

Based on the news report, it is unclear specifically what happened.  Police are investigating the cause of the accident and have not disclosed a cause of the accident. It was not mentioned if alcohol or drugs were suspected to have played a role in the crash, or if the driver was cited.

Nevada Statute 484B.287 states that pedestrians have the right-of-way in crosswalks and at intersections. The same statute goes on to state: “A pedestrian shall not suddenly leave a curb or other place of safety and walk or run into the path of a vehicle which is so close that it is impossible for the driver to yield.”

In other words, a pedestrian cannot suddenly dart into the roadway or “jaywalk.”
