Cause of the September 30th North Las Vegas Pedestrian Accident
The cause of this accident is under investigation, police did not provide a cause of the accident. Under Nevada Statute 484B.287, vehicles are expected to yield to pedestrians using a crosswalk or obeying crossing signage at a local intersection. It is unclear if the pedestrian, in this case, was crossing at a crosswalk or outside of one.
In 2018, the most recent year statistics are available, an estimated 7,680 people were killed in pedestrian accidents in the U.S. Top causes of pedestrian accidents are driver distraction, speeding, and simply failing to see a pedestrian. Pedestrian Accidents Are a Serious Issue in Nevada
Earlier this year, the Nevada Department of Public Safety’s Office of Traffic Safety reported that from 2014 to 2018, Clark County accounted for about 76% of all pedestrian fatalities in Nevada. It has been well-established that pedestrians in Las Vegas are extremely vulnerable to accident, injury, and death. Last year, 91 white drawings were placed throughout the city, outlining where 91 pedestrians were killed in 2018 and 2019. Only 22 of the 91 accidents did not happen between dusk and dawn. Pedestrians are extremely vulnerable when visibility is reduced
The Regional Transportation Commission of Southern Nevada (RTC) has made improvements to improve pedestrian safety at bus shelters in Southern Nevada, pushing back bus stops wherever not prohibited by private property and lack of right-of-way. Federal funding has also been allocated for extra patrols to discourage speeding and reckless driving.
Civil Liability For Pedestrian Accidents in Nevada
If the driver of the vehicle is determined to have caused this accident, he or she may be liable for the victim’s wrongful death. An attorney can review the accident reports and help determine if the family may have a claim. Damages available in a wrongful death claim include final medical bills, funeral and burial expenses, and loss of love and companionship. It is always advisable to contact a skilled and knowledgeable lawyer as soon as possible.
