Pedestrian Killed Crossing Las Vegas Roadway
Authorities in Las Vegas are dismayed to report another pedestrian accident occurred on April 13th, and the accident was fatal for the victim. According to initial reports, the victim was reportedly walking near a fairly busy roadway at around 8:40 P.M. The pedestrian decided to attempt to cross the road at the intersection of North Nellis Boulevard and East Bonanza Road.
That’s when a pickup truck, heading south on Nellis, struck the pedestrian. Unfortunately, this accident happened late in the evening, so it was likely harder to see the pedestrian attempting to cross the road without much light. Even worse, it’s been reported that the pickup truck was approaching a green light, so the truck did have the right of way. Authorities further noted that the pedestrian was attempting to cross the road in an area where there was no marked crosswalk.
When authorities arrived, they discovered the 39-year-old Las Vegas resident suffering from critical injuries. He was rushed to the nearby University Medical Center, where he was unfortunately declared deceased a short time later.
The driver of the pickup truck, a 36-year-old Las Vegas resident, was uninjured. Authorities also confirmed that there were no clear signs of impairment.
Right now, the accident is still under investigation.
How to Cope With Fatal Pedestrian Accidents as a Surviving Loved One
A fatal pedestrian accident is devastating on so many levels. Not only is a life taken too soon, but the accident can also add financial strain onto a family that’s already grieving the loss of a loved one. The surviving loved ones of the pedestrian might experience multiple losses after the accident including struggling with medical bills prior to their loved one’s passing, experiencing a sudden lack of spousal or parental financial support, and even contending with debts that the pedestrian left behind.
One shining ray of hope for families who are struggling with such losses comes in the form of legal recourse. After a fatal pedestrian accident, it’s in the family’s best interests to investigate the situation to determine what happened.
While it’s not always possible to recover financially after a pedestrian accident, it is possible to seek out a claim when the motorist was negligent.
Under the law in Las Vegas, every motorist (and pedestrian) has an automatic legal duty to provide for the care and safety of everyone else on the road. In other words, every pedestrian and motorist is expected to act reasonably to ensure everyone else’s safety. If one person breaches this duty of care and causes an accident, then that party would be considered legally negligent.
Under the law, the negligent party is also legally liable for the financial fallout from the crash. The negligent party will usually need to cover any financial losses experienced by the non-negligent party.
If you’ve recently experienced an accident that led to a host of financial losses, then it makes the most sense to consider your legal options. You may be able to seek out financial compensation that covers your losses. To learn more, schedule a consultation with our attorneys.
