Bicyclist Struck and Killed in December 28 Central Las Vegas Crash
A 71-year-old man was tragically killed on December 28th in a crash in central Las Vegas, the Las Vegas Review-Journal reported. The accident occurred in the 1700 block of East Charleston, near South 17th Street, at 2:50 in the afternoon. According to police, the man was riding an electrical bicycle when the driver of a Lexus sedan, a 62-year-old Las Vegas women, pulled out of a private driveway, and struck him. He was taken to University Medical Center where he passed away of his injuries.
The cause of the fatal bicycle accident remains under investigation. Police said there were no signs that the driver of Lexus was impaired. Our thoughts go out to the family of the victim of this crash. Losing a loved one unexpectedly is heartbreaking, shocking, and painful.
E-bikes and scooters are relatively new, and liability and legal matters involving E-bike collisions is still in the early stages. We do know that electric bikes can travel up to 20-25 miles per hour, which is faster than a bicyclist on a regular pedal road bike. Excess speed in a crash will make any collision more serious and will reduce the reaction time of both parties.
It will also be more difficult for the driver of the sedan to judge the traveling speed. The faster the bicycle is traveling, the less time the driver of the sedan will have to react. Sometimes drivers believe an oncoming bicyclist is traveling slowly and that they have enough time to cross a path.
Drivers of vehicles must always look for pedestrians and bicyclists. Many collisions involving a vehicle and a bicycle occur because the driver of the vehicle is focusing on looking for other vehicles, and not bicyclists. If the driver of the sedan was distracted, or failed to see the cyclist and pulled into their path, the driver may be liable for the victim’s wrongful death. The driver’s insurance policy may compensate the victim’s family for funeral and burial expenses, final medical costs, and loss of love and companionship.
Following an accident such as this one, victims and their families are well-advised to speak with a knowledgeable and experienced Las Vegas wrongful death lawyer as soon as possible. Speaking with a lawyer can ensure legal rights are protected, and nothing is done to decrease the value of a claim. It is always advisable to not accept any compensation offer from an insurance company without first speaking to a lawyer.
